No two domestic violence cases are alike. These types of cases can involve spouses and other family members, people who live together, and other individuals involved in some type of relationship. Domestic violence can involve many forms of mistreatment and control, including physical violence, harassment, sexual abuse, social isolation, and psychological or emotional abuse.

Domestic Violence Charges

Law enforcement and judicial officials cite domestic violence cases as some of the toughest they face. Often an embittered spouse will accuse the other of domestic violence to gain an edge in a future divorce proceeding. In other cases, victims are reluctant to report the abuse because they have feelings for the offender or they feel they can't make it financially on their own. However, if police see evidence of physical violence, such as bruises, cuts, or other wounds, they can file charges without the victim's cooperation. This provision was added to the law because some victims will not press charges.

Punishment for Domestic Violence

The majority of domestic violence cases result in misdemeanor charges of battery or simple assault. The offender may be required to spend a short time in jail, serve a sentence on probation, and undergo counseling. Often a restraining order may be issued prohibiting the offender from being near his or her victim. Sometimes, the victim wants to reconcile with the offender and will request that the restraining order be lifted or not issued at all. In other cases, especially those in which the violence is severe, charges of aggravated assault or attempted murder may be filed. In these situations, the offender usually has a history of abusing the victim or others. Punishment for felony domestic violence charges includes a prison sentence in most cases.
