About the Trial Process

A criminal trial is an examination of facts and arguments in court in front of a judge and, in most cases, a jury. A trial without a jury is called a court trial, when the judge decides the ruling of a case after hearing arguments from criminal law attorneys on either side of the case. As part of the judiciary system, everyone accused of a crime is allowed the right to a trial in order to protect his or her constitutional rights. When a person is formally accused of a crime, the case is presented to the court for trial. Next, a jury is selected by questioning potential jurors. The prosecution and defense attorneys work together to decide upon a fair jury. At the beginning of the trial, each side presents its case to the court through opening statements, and then evidence for both sides is presented. Evidence can range from the accounts of witnesses to exhibits with physical evidence. The attorneys on both sides are given the opportunity to present counter arguments that challenge the other party's evidence. Closing arguments are made, and the jurors are advised of the laws pertaining to their case by the judge. The jury then deliberates and decides on a verdict.

Filing a Motion for Appeal

After a verdict has been reached in a criminal law case, the attorneys have the opportunity to file a motion for appeal on behalf of the defendants. In essence, the defense asks a higher court to reverse the judgment reached by a trial court. When criminal defense lawyers file a motion for appeal, they are not allowed to introduce any new evidence to the case. Instead, the appellate court (the court hearing the appeal) will assess the evidence produced during the trial hearing and decide whether the law and decision applied to that evidence was legally valid.

Both parties have the opportunity to present briefs explaining their reasons for reversing or upholding the trial court's ruling. After the lawyers present their initial and counter arguments, the judge will decide to sustain the original ruling, reverse it, or partially sustain and partially reverse the verdict.
